Law360, New York (March 18, 2011, 6:23 PM ET) -- Generic-drug maker SigmaPharm Inc. on Friday appealed a Pennsylvania federal judge's dismissal of its antitrust and contract suit against Mutual Pharmaceutical Co. Inc. and King Pharmaceuticals Inc. over royalties for a potential generic version of muscle relaxant Skelaxin.
A notice of appeal was filed in the U.S. District Court for the Eastern District of Pennsylvania, a couple of weeks after Judge Cynthia M. Rufe threw out SigmaPharm's suit. The case is being appealed to the U.S. Court of Appeals for the Third Circuit.
