Judge Excludes Accutane Maker's Own Assessments

Law360, New York (May 04, 2007, 12:00 AM ET) -- The manufacturer of the acne drug Accutane scored a victory Wednesday, when Judge James S. Moody, Jr. granted its hotly contested motion to exclude any evidence related to “causality assessments” that address Accutane’s potential to cause inflammatory bowel disease.

The plaintiffs, who are Accutane users suing for damages, had wanted to use these assessments as evidence of Accutane’s maleficent side effects, and as proof that Hoffmann-LaRoche, Accutane’s manufacturer, was aware of them.
