Apotex Can't Dodge Schering Suit Over Nasonex IP

Law360, New York (June 15, 2011, 7:20 PM ET) -- A New Jersey federal judge on Wednesday refused to grant Apotex Inc. a ruling that it does not infringe one of three patents covering Nasonex nasal spray, in a suit lodged by Schering Corp. to block a generic version of the treatment.

U.S. District Judge Garrett E. Brown Jr. denied Canadian drugmaker Apotex's motion for summary judgment of noninfringement. He filed his opinion under seal to give the companies seven days to propose redactions.
