Judge Tosses FTC Suit Challenging Hospital Merger

Law360, New York (June 27, 2011, 11:08 PM ET) -- A federal judge in Georgia on Monday tossed the Federal Trade Commission’s case challenging Phoebe Putney Health System Inc.’s proposed acquisition of Palmyra Park Hospital Inc., ruling the health care company was immune from antitrust claims.

U.S. District Judge W. Louis Sands dismissed the FTC’s complaint with prejudice and said Phoebe Putney could not be held liable for antitrust accusations because it was working on behalf of a state government agency, the Hospital Authority of Albany-Dougherty County.
