HGS Patent Suits Against Genentech Head To Calif.

Law360, New York (July 19, 2011, 3:48 PM ET) -- A Delaware federal judge on Monday moved three declaratory judgment and antitrust suits filed by Human Genome Sciences Inc. against Genentech Inc. to California, ruling a California judge's expertise with a patent-in-suit outweighs HGS' desire to keep the cases in Delaware.

In three suits filed between January and April, HGS brought declaratory judgment, antitrust, Lanham Act and state tort claims against Genentech over U.S. Patent Numbers 6,331,415 and 7,923,221, known as the Cabilly II and Cabilly III patents, respectively.
