Pfizer Can't Shake Investor Suit Over Off-Label Marketing

Law360, New York (August 10, 2011, 3:21 PM ET) -- A New York federal judge refused Wednesday to dismiss a putative securities class action stemming from a $2.3 billion civil and criminal fine Pfizer Inc. paid for illegally marketing off-label uses of four drugs and offering doctors kickbacks to promote the medications.

The company had argued that the “plaintiffs’ prolix and confusing complaint — their third — [failed] to remedy the shortcomings identified” in an April order instructing them to refer only to certain exhibits necessary for the understanding of the allegations.
