Alcon Sues Generics Maker Over Nasal Spray Patent

Law360, New York (October 17, 2011, 7:00 PM ET) -- Alcon Pharmaceuticals Ltd. filed a patent infringement suit against Perrigo Co. in Texas on Friday in an effort to keep the generic-drug company from developing its own version of seasonal allergy relief nasal spray Patanase.

Alcon, a subsidiary of Novartis AG, claims Perrigo’s abbreviated new drug application submitted to the U.S. Food and Drug Administration for approval to market a version of olopatadine hydrochloride solution — the generic form of Patanase — infringes its patent.
