HSG Gene Sequence Patent Valid: UK High Court

Law360, New York (November 02, 2011, 2:41 PM ET) -- In one of the first British cases to deal with the limits of the utility requirement for biotech patentability, the U.K. Supreme Court on Wednesday upheld a Human Genome Sciences Inc. patent for a gene sequence in a dispute with Eli Lilly & Co.

In finding the patent valid, the Supreme Court overturned a British appeals courts' ruling that the patent was invalid for lack of industrial application. The court instead sided with the European Patent Office, which had found that the patent was valid....
