Law360, New York (December 12, 2011, 7:09 PM ET) -- Cephalon Inc. and Mylan Inc. fired back Friday at Impax Laboratories Inc.'s bid to have itself excluded from an injunction barring generic versions of Cephalon's muscle relaxant Amrix, saying Impax is seeking an improper "do-over" of the decision.
According to Mylan, Impax never participated in the hearing at which it was added to the injunction, so its motion seeking reargument of the decision is merely an attempt to revisit a ruling it does not like.
