Law360, New York (December 12, 2011, 6:19 PM ET) -- The U.S. Supreme Court on Monday declined to hear an appeal filed by a group of pharmacies and pharmacists who alleged the $68 billion merger of Pfizer Inc. and Wyeth in 2009 threatened smaller businesses by reducing competition.
Seven plaintiffs, including Golden Gate Pharmacy Services Inc., Marin Apothecaries and Pediatric Care Pharmacy Inc., filed a lawsuit in 2009 alleging the merger violated Section 7 of the Clayton Act and Section 1 of the Sherman Act because Pfizer and Wyeth were direct competitors in several pharmaceutical submarkets....
