Ortho-McNeil Sues Apotex Over Ultracet Patent

Law360, New York (July 23, 2007, 12:00 AM ET) -- Johnson & Johnson subsidiary Ortho-McNeil Pharmaceutical Inc. has sued rival drug company Apotex Inc. for allegedly planning to infringe its patent on the pain killer Ultracet.

The complaint was filed last Wednesday in the U.S. District Court for the Northern District of Illinois. In it, Ortho-McNeil asked for a declaratory judgment of infringement and for the court to order the FDA not to approve Apotex's ANDA.

The company also said the case was “exceptional” and merited the award of attorneys' fees.
