Attorneys Plead For New Class In Fosamax Case

Law360, New York (August 20, 2007, 12:00 AM ET) -- Hoping to pursue a two-pronged campaign against Merck & Co., the attorneys involved in the Fosamax product liability litigation have asked the court to certify a class of plaintiffs apart from those who claim to have suffered painful deterioration of the jaw after taking the osteoporosis medication.

On Friday, lead plaintiffs' attorney Timothy O'Brien filed a class certification motion, urging the court to allow the Fosamax patients who have yet to develop osteonecrosis of the jaw to collectively pursue their request for a dental monitoring program....
