Antitrust Group Backs FTC In 4th Circ. Teeth Whitening Fight

Law360, New York (July 06, 2012, 6:45 PM ET) -- The American Antitrust Institute warned the Fourth Circuit on Thursday that tossing the Federal Trade Commission's teeth whitening antitrust decision against North Carolina's dental board would encourage other licensing boards to block competitors without clear state approval.

The interest group urged the appeals court not to endorse the broad view that the North Carolina State Board of Dental Examiners took of the state action doctrine — which shields state and state-sanctioned conduct from antitrust scrutiny under certain conditions — in its appeal of the FTC's decision...
