AstraZeneca Loses Bid To Toss Strict Liability Claims

Law360, New York (November 29, 2007, 12:00 AM ET) -- Pharmaceutical company AstraZeneca has lost a battle to toss strict liability claims from the consolidated cases of thousands of Seroquel users who claim they developed diabetes after taking the anti-psychotic drug.

The federal judge in charge of multidistrict litigation over the blockbuster medication on Tuesday denied the drug maker's bid to dismiss the design-defect and implied warranty claims from more than 3,600 plaintiffs whose cases have been transferred to the Orlando district court for pre-trial proceedings in the product liability action.
