Generics Makers Denied In Diabetes Drug Patent Suit

Law360, New York (February 22, 2006, 12:00 AM ET) -- Takeda Pharmaceutical Company has prevailed in a patent infringement suit filed three years ago against three generic drug makers after a judge upheld the patent covering the key ingredient in the company’s blockbuster diabetes treatment ACTOS.

The ruling dealt a blow to patent challengers Mylan Pharmaceuticals and Alphapharm, both of which had challenged the patent for the active ingredient in the drug.
