AstraZeneca Starts Patent Squabble With IVAX

Law360, New York (March 08, 2006, 12:00 AM ET) -- In a move to fend off a rival’s attempts to produce and market a generic form of Nexium, AstraZeneca AB has fired off a lawsuit against drug maker IVAX Corporation for allegedly infringing on patents related to its widely prescribed ulcer drug.

AstraZeneca’s infringement claims come in response to IVAX’s recent Abbreviated New Drug Application filed with the U.S. Food and Drug Administration.

IVAX is seeking to market esomeprazole magnesium, a generic version of Nexium, before five of AstraZeneca’s patents expire.
