Law360, New York (August 22, 2008, 12:00 AM ET) -- Eli Lilly & Co. has dropped a third generic-drug company from its patent suit over Strattera, a drug used to treat attention-deficit hyperactivity disorder, after Synthon Laboratories Inc. agreed to withdraw its abbreviated new drug application for the drug.
The stipulation and order, approved Wednesday in the U.S. District Court for the District of New Jersey, provides for the dismissal of the claims and counterclaims between the two parties without prejudice.
