Law360, New York (September 04, 2008, 12:00 AM ET) -- A federal judge has rejected drugmaker GlaxoSmithKline PLC's contention that federal law preempts a failure-to-warn product liability suit over Paxil, in a case involving a 16-year-old boy who killed himself while taking the antidepressant.
On Aug. 28, Judge Ronald L. Buckwalter the U.S. Court for the Eastern District of Pennsylvania denied GSK's motion for summary judgment and ruled that federal law did not preempt New Jersey state law in the case.
