Fed. Circ. Upholds Bar On Generic Prevacid For Teva

Law360, New York (November 07, 2008, 12:00 AM ET) -- Sustaining a district judge's March decision, a federal appeals court has ruled that Teva Pharmaceutical Industries Ltd. failed to prove that two patents for Takeda Pharmaceutical Co. Ltd.'s acid reflux treatment Prevacid were invalid due to obviousness or inequitable conduct.

In a per curiam judgment Friday, the U.S. Court of Appeals for the Federal Circuit affirmed Judge Sue L. Robinson's decision blocking the Israeli generics maker from entering the U.S. market for Prevacid until May 10, 2009, when one of the patents expires.
