Fed. Circ. Upholds Validity Of Sanofi's Plavix Patent

Law360, New York (December 12, 2008, 12:00 AM ET) -- In an upset for Canadian generic-drug maker Apotex Inc., a federal appeals court has upheld a lower court’s ruling that a patent covering the active ingredient in Sanofi-Aventis’ blockbuster blood-thinner Plavix is valid.

The U.S. Court of Appeals for the Federal Circuit on Friday affirmed a June 2007 decision by a New York district court that rejected Apotex’s claims that the patent related to clopidogrel bisulphate was invalid due to anticipation and obviousness.

By affirming the patent’s validity, the Federal Circuit also effectively upheld the U.S....
