Law360, New York (December 29, 2008, 12:00 AM ET) -- Bayer HealthCare LLC has sued Abbott Laboratories, alleging that Abbott's hugely popular arthritis drug Humira infringes a Bayer patent.
In a complaint filed Wednesday in the U.S. District Court for the Eastern District of Texas, Bayer accused Abbott of infringing U.S. Patent Number 5,654,407, titled “Human anti-TNF antibodies,” by selling Humira in the U.S.
The '407 patent, issued in 1997, describes an antibody that binds to human tumor necrosis factor alpha, a compound involved in inflammatory diseases.
