Law360, New York (February 02, 2009, 12:00 AM ET) -- Affirming the trial court's finding, a federal appeals court ruled Monday that Kinetic Concepts Inc.’s patents for a wound-healing vacuum technology were valid but not infringed by BlueSky Medical Group Inc.’s similar suction device.
Judges Sharon Prost and William C. Bryson of the U.S. Court of Appeals for the Federal Circuit denied Blue Sky’s bid to invalidate the patents, holding that the district court correctly determined that prior art did not render the two patents obvious and unenforceable.
