Judge Accuses Stryker Of Warped Riegel Reading

Law360, New York (February 12, 2009, 12:00 AM ET) -- A judge has denied a motion by Stryker Orthopaedics to toss a product liability case over its Trident hip implant, saying the company was trying to stretch last year's U.S. Supreme Court medical device preemption ruling “beyond recognition.”

On Wednesday, Chief Judge David Hamilton of the U.S. District Court for the Southern District of Indiana rejected Stryker's reading of the high court's holding last February in Riegel v Medtronic, and ruled that the suit could proceed.
