Law360, New York (October 05, 2009, 3:27 PM ET) -- A federal judge has refused to certify an appeal brought by a consortium of insurers involved in flooring company Congoleum Corp.'s bankruptcy case, hoping to keep the proceedings moving after years of setbacks and delays.
U.S. District Judge Joel Pisano on Friday shot down the request for an interlocutory appeal of an Aug. 17 order, citing the need for judicial economy and the desire to avoid repetitive appeals and piecemeal litigation.
