Law360, New York (October 27, 2009, 6:39 PM ET) -- Farmers Group Inc. has won its bid for an en banc review of an appeals court panel's 2-1 decision to revive a homeowner's putative class action alleging the insurer charged minorities higher premiums than their white counterparts.
Chief Judge Alex Kozinski of the U.S. Court of Appeals for the Ninth Circuit said in an order Monday that the three-judge panel's May opinion, which reversed a district court's decision to throw out the suit, should not be used as precedent.
