Insurer's Claims Survive In 'Idol' Producer IP Spat

Law360, New York (October 18, 2010, 5:20 PM ET) -- A federal judge has preserved the bulk of AXA Insurance Co.'s case against “American Idol” producer FremantleMedia North America Inc. in a dispute over a trademark infringement suit related to a different reality show made by the company.

Judge R. Gary Klausner of the U.S. District Court for the Central District of California issued the ruling Friday, denying FremantleMedia's motion to dismiss AXA's breach of contract and fraud by concealment counterclaims. The judge, however, did agree to throw out unjust enrichment and rescission claims.
