Law360, New York (December 07, 2010, 4:41 PM ET) -- Bryan Cave LLP and a unit of American Express Co. have won further dismissal of claims against them in a putative class action alleging they misled plaintiffs about the viability of a life insurance-based tax shelter that the Internal Revenue Service later found illegal.
In an order filed Monday in the U.S. District Court for the Northern District of Texas, Judge Jane J. Boyle admitted that she was wrong to let claims of negligent misrepresentation against the two stand.
