Law360, New York (December 05, 2011, 8:07 PM ET) -- A Florida federal judge ruled on Monday that two insurers do not have to defend KB Home Inc. against claims over defective Chinese drywall used in its houses because the damage falls under a total pollution exclusion in their policies.
U.S. District Judge Susan C. Bucklew granted Granite State Insurance Co. and New Hampshire Insurance Co. summary judgment in their suit against KB and American Building Materials Inc., which purchased the insurance policies and supplied the allegedly defective drywall to KB Home.
