Humana Can't Shake Insurer's $2.2M Medicare Pay Suit

Law360, New York (May 17, 2012, 7:32 PM ET) -- An Arizona federal judge Thursday refused to dismiss Fox Insurance Co.'s suit claiming Humana Inc. improperly took over $2.2 million in Medicare Part D prescription drug reimbursements that were intended for Fox, ruling that the insurer's allegations were sufficient to sustain the suit.

While U.S. District Judge Roslyn O. Silver retained Fox's claims of intentional interference with contract and unjust enrichment, though she tossed the company's conversion claim. She also rejected Humana's bid to add the Centers for Medicare and Medicaid Services, which allegedly paid Humana...
