Breaking The 'Mold': NYC Landlords' Exposure Liability

Law360, New York (May 29, 2012, 1:00 PM ET) -- Although New York City landlords and co-op and condo board members typically do not inhabit the properties they own and manage, a recent New York Appellate Division, First Judicial Department decision gives them reason to fear the impact of mold infestation.

Following a 2009 New York Supreme Court decision holding that there is a lack of scientific evidence to enable an individual to collect damages for an injury caused by mold exposure, the real estate community was able to breathe easy.
