Law360, New York (July 13, 2012, 3:51 PM ET) -- The Hanover Insurance Co. sued Urban Outfitters Inc. in Pennsylvania federal court on Thursday, seeking to avoid covering the Philadelphia-based retailer's defense against a copyright infringement suit filed by the Navajo Nation American Indian tribe.
The insurer contends the alleged infringement committed by Urban Outfitters occurred before its commercial liability policy went into effect. Though Hanover has begun representing Urban Outfitters in the suit, it seeks a declaratory judgment releasing it from the continued obligation to defend the retailer.
