Law360, New York (July 19, 2012, 8:11 PM ET) -- A Massachusetts federal judge on Wednesday affirmed a lower court's decision that U.S. Fire Insurance Co. should have to pay 43 percent of Peabody Essex Museum's up to $1.5 million cleanup costs for an oil spill on its property, with double damages.
U.S. District Judge Nathaniel M. Gorton largely refused U.S. Fire's motion to reconsider U.S. District Judge Nancy Gertner's decision from last August in the “interminable action” over allocation of indemnity, but did reduce U.S. Fire's allocation for one type of cost.
