Higher Medical Awards May Be Closer To Reality In Calif.

Law360, New York (August 29, 2012, 6:27 PM ET) -- A bill championed by consumer attorneys that could help patients win larger judgments in personal injury cases advanced Tuesday in the California Assembly, setting up a showdown with insurers that are worried the legislation will undermine a state Supreme Court ruling and cost them billions of dollars annually.

The proposal, which would let patients recoup the “reasonable and necessary value of medical services,” was approved in committee on a 6-3 vote and emerged in the wake of the decision last year in Howell v. Hamilton Meats....
