Policyholders Lose Last Leg In Chinese Drywall Case

Law360, New York (March 13, 2015, 11:06 AM EDT) -- The last decade has seen millions of dollars in homeowner claims as a result of defective drywall that was imported from China prior to 2008. One of the principal issues raised by such litigation was whether the property owners' homeowner's policies afforded first-party coverage for the damage. Courts determined relatively quickly that the primary coverage grants under such contracts of insurance did not afford any coverage, but policyholders persisted, arguing that there might nonetheless be coverage under secondary coverage provisions. Earlier this year, a Virginia court nixed that argument for coverage as well....
