SKF Looks To High Court To Nullify Byrd Amendment

Law360, New York (February 12, 2010, 6:12 PM ET) -- Certain U.S. manufacturers are keeping their fingers crossed that the U.S. Supreme Court will elect to hear an appeal that could invalidate as unconstitutional the Continued Dumping and Subsidy Offset Act of 2000 — a law that has already been partially repealed once.

Since its inception, the act, commonly called the Byrd Amendment, has frustrated an array of producers whom it bars from sharing in the proceeds of anti-dumping duties based on their support or opposition for the initial duty petition.
