Law360, New York (November 12, 2010, 5:17 PM ET) -- A federal judge has declined to grant immunity to a Malaysian man so he can travel to the U.S. to testify for a colleague charged with leading a conspiracy to illegally export military hardware to China.
The power to grant immunity from prosecution, normally the sole province of the U.S. Department of Justice, can only be invoked by a judge in cases of severe prosecutorial misconduct, Judge Douglas P.
