Chinese Pencils Subject To Lower Duties, Target Says

Law360, New York (December 08, 2010, 2:34 PM ET) -- Target Corp. has accused the Department of Commerce's International Trade Administration of slapping a China-wide 114.9 percent import duty rate on pencils the retailer imported from two Chinese companies that were actually subject to a lower rate.

Liquidation instructions for certain cased pencils from China should have included exporter/importer-specific rates for pencils that Target bought from China First Pencil Co. and Shanghai Three Star Stationery Co. Ltd., Target alleges in a complaint filed Monday by John M. Peterson of Neville Peterson LLP in the U.S. Court...
