Commerce Must Review Chinese Chemical Duty Ruling: CIT

Law360, New York (November 29, 2011, 4:02 PM ET) -- A U.S. Court of International Trade judge has partially remanded an anti-dumping duty review for chlorinated isocyanurates from China, saying the U.S. Department of Commerce has not adequately explained how it reached its findings, according to a decision made public Monday.

CIT Judge Richard K. Eaton ordered Commerce to review several portions of its second administrative review of chlorinated isocyanurates from China, ruling the agency had not sufficiently explained why it had used Indian market prices as surrogates for Chinese prices instead of Philippine data....
