Law360, New York (January 18, 2012, 2:18 PM ET) -- The U.S. Court of International Trade on Tuesday tossed a suit brought by a ball bearing manufacturer challenging the constitutionality of the Continued Dumping and Subsidy Offset Act of 2000, finding the company’s claims were meritless.
A three-judge panel granted the government’s motion to dismiss the consolidated suit, ruling Schaeffler Group USA Inc. had failed to state claims different from those that the court rejected in previous litigation over the legality of the CDSOA.
