Law360, New York (August 22, 2012, 8:32 PM ET) -- The U.S. International Trade Commission used the wrong legal standard to rule that a semiconductor patent Amkor Technology Inc. asserted against Carsem Inc. was invalid because it had previously been invented by another company, the Federal Circuit ruled Wednesday.
The ITC incorrectly concluded that Amkor's patent had been previously disclosed in the U.S. by Chinese chipmaker ASAT Inc., the Federal Circuit said, reversing the ruling and remanding for further proceedings.
