BAE-EADS Merger Would Test Toughened CFIUS Laws

Law360, New York (September 14, 2012, 9:33 PM ET) -- In addition to gaining European antitrust approval, any merger between the continent's two aerospace giants, BAE Systems PLC and European Aeronautic Defence & Space Co., would have to pass muster in the U.S., where experts say Clinton-era support for foreign defense partnerships has waned and regulatory review has sharpened in the wake of the 2006 controversy over U.S. port security.
