Law360, New York (October 11, 2012, 6:29 PM ET) -- The U.S. Court of International Trade dismissed a lawsuit Thursday brought by Chinese extruded aluminum producers challenging the U.S. Department of Commerce's decisions to treat them as one entity and slap them with a 33 percent dumping duty rate because of an alleged failure to cooperate.
Judge Donald C. Pogue tossed a case brought by Guang Ya Aluminum Industries Co. Ltd. and Zhaoqing New Zhongya Aluminum Co. Ltd., affirming a final determination from Commerce that imposed a 33.28 percent "adverse facts available" rate on the companies....
