US Challenges China On Export Duties At WTO — Again

Law360, New York (July 18, 2016, 11:49 AM EDT) -- On July 13, the United States requested consultations with China at the World Trade Organization on China's application of export duties on a range of raw material products where such application is inconsistent with China's Protocol of Accession to the WTO. The request for consultations marks the third time that the United States (previously in concert with other trading partners) has challenged China on its excessive use of export duties. Twice before, the WTO has found China to be acting inconsistently with its obligations.[1] Prior cases make it clear that export duties can only be applied on the 84 products contained in Annex 6, cannot be at levels on those products that exceed the level listed in the Annex with no exceptions available under the Protocol or under Article XX of the General Agreement on Tariffs and Trade 1994....
