Fed. Circ. Backs Invalidation Of PureChoice Patent

Law360, New York (June 02, 2009, 12:00 AM ET) -- A federal appeals court has upheld a lower court’s ruling that PureChoice Inc.’s patent for an indoor air quality monitoring system is invalid due to indefiniteness, affirming the dismissal of the company’s infringement suit against Honeywell International Inc.

Judges Haldane Mayer, Arthur Gajarsa and Richard Linn of the U.S. Court of Appeals for the Federal Circuit on Monday affirmed the trial court’s claim construction and its decision to grant Honeywell summary judgment, ruling that the patent-in-suit is too imprecise to withstand invalidation.
