Avery Dennison RFID Case Stayed For PTO Re-Exam

Law360, New York (July 21, 2009, 5:46 PM ET) -- A federal judge has stayed a lawsuit brought by Avery Dennison Corp. against Alien Technology Corp. pending re-examination of the three remaining patents, which relate to radio frequency identification technology.

Judge Kathleen M. O'Malley of the U.S. District Court for the Northern District of Ohio ruled Monday that the re-examination proceedings before the U.S. Patent and Trademark Office would likely moot or narrow some or all of Avery's claims and simplify the issues to be litigated.
