USPTO Finds Blood-Collecting Device Patent Invalid

Law360, New York (October 09, 2006, 12:00 AM ET) -- The United States Patent and Trademark Office has initially invalidated seven claims in a review over a patent for a microcuvette, a blood-collecting and testing device, a move that could affect a pending antitrust lawsuit.

The USPTO on Aug. 2, 2005 granted a reexamination for seven claims on one of HemoCue’s patents in a hematology patent battle between the Boerne, Texas-based Stanbio Laboratory LP and Swedish medical diagnostic products maker HemoCue.
