Law360, New York (September 22, 2009, 6:30 PM ET) -- The U.S. International Trade Commission has made an initial determination in LSI Corp. and Agere Systems' battle over their patent for a semiconductor chip, finding the patent invalid because of anticipation by IBM Corp.
ITC Administrative Law Judge Carl C. Charneski signed off on the initial determination Sept. 21, finding the patent invalid because of anticipation by IBM's “Process A” and clearing seven semiconductor companies of alleged violations of Section 337 of the Tariff Act.
