Law360, New York (October 30, 2006, 12:00 AM ET) -- Three months after a federal appeals court dismissed allegations of so-called monopoly leveraging against drug maker Abbott Laboratories Inc., the lead plaintiff in the class action has appealed the decision to the U.S. Supreme Court.
The petition for writ of certiorari, filed Oct. 24 by plaintiffs’ law firm Barnow & Associates PC, seeks to overturn the U.S. Court of Appeals for the Seventh Circuit’s finding that Abbott didn’t violate the Sherman Act when it raised the price of a component of an HIV drug.
