Emcore Asks ITC To Bounce Avago Patent Expert

Law360, New York (November 03, 2009, 7:35 PM ET) -- Semiconductor company Emcore Corp. has asked the U.S. International Trade Commission to exclude the testimony of a patent expert provided by rival Avago Technologies Ltd., arguing that it would be “unhelpful and unnecessary” to the case over whether Emcore imported optoelectronic devices that infringe Avago's patents.

Emcore filed its motion in limine Monday, asking the administrative law judge to block the testimony of Houston patent attorney Alan H. Gordon, who is scheduled to testify on the practices of the U.S. Patent and Trademark Office.
