Law360, New York (January 14, 2010, 5:28 PM ET) -- Apotex Inc. has asked a federal judge in Delaware to dismiss patent infringement claims brought by Abbott Laboratories Inc. over a generic version of Abbott's weight-loss drug Meridia because the case has no ties to the state.
Abbott has already smacked Apotex with an identical suit in Illinois, which both sides supposedly agree is the right venue, according to Apotex's motion to dismiss the case for lack of personal jurisdiction, filed on Wednesday in the U.S. District Court for the District of Delaware.
